Open Source Licence Agreement
NovoPsych’s mission is to help mental health services use psychometric science to improve client outcomes.
In line with this mission, the assessments we author are open source: researchers, educators and clinicians working with their own clients can use, copy and translate them free of charge, with no permission needed in most circumstances. Commercial use above the limits below, and any use by competing assessment services, needs a licence from us. Please review the agreement below.
NovoPsych Open Source Psychometric Assessment Licence Agreement
Updated October 2026.
This Licence Agreement (“Agreement”) governs the use, administration, reproduction, distribution and modification of psychometric assessments authored by NovoPsych Pty Ltd (“NovoPsych”), or of which NovoPsych is the copyright owner or rights holder (each an “Assessment”). It does not apply to scales owned by third parties, which NovoPsych administers under seperate agreements from their authors. Resources NovoPsych creates about any scale, including these, are licensed under the NovoPsych Resources Licence Agreement.
NovoPsych develops these Assessments as open-source measures so that clinicians and researchers can use, study, translate and build on well-constructed instruments without cost, and so that the measures can become standards through published research. This Agreement follows open-source principles: the items, instructions, scoring keys, subscale structure and published norms are open to all, and derivative works must be shared under the same terms. The two reservations are commercial use above the limits in clause 4, and use by competing assessment services, both of which require a licence from NovoPsych.
By downloading, accessing, administering or using an Assessment you agree to be bound by this Agreement. If you do not agree, you must not use the Assessment.
Assessments under this licence
– Multilevel Assessment of Psychopathology (MAPsy)
– Maladaptive Schema Scale (MSS)
– Maladaptive Schema Scale – Young Schema Aligned (MSS-YSQ)
– NovoPsych Five Factor Personality Scale (NFFP-30)
– Client Satisfaction Scale (CSS)
1. Definitions
“Assessment” includes the items, instructions, response formats, scoring keys, subscale structure, normative data, cut-offs, interpretive text, manuals and any other material NovoPsych publishes for the measures listed above, in any language or format.
“Scoring Logic”, “Platform Outputs”, “Organisation”, “User”, “Commercial Use”, “Competing Service” and “Research Use” have the meanings given in the NovoPsych Resources Licence Agreement, applied to the Assessment.
“Administration” means one administration of an Assessment to one client, patient, respondent or other person on one occasion.
2. Licence Grant
NovoPsych grants you a worldwide, non-exclusive, non-transferable, revocable licence to use, administer, reproduce, distribute and modify the Assessment, only as permitted by, and subject to, this Agreement.
3. Free Permitted Uses
No permission or fee is required for the following uses, provided the Restrictions in clause 6 are observed.
- Clinical use by practitioners. A health practitioner may administer, score, copy and adapt the Assessment in their own clinical work with their own clients/patients, including in private practice and on paper, provided the Organisation’s use stays within the Free Use Limits in clause 4.
- Non-commercial use. Not-for-profit health services, educational institutions and individuals may use, copy and adapt the Assessment for health, educational and academic purposes without commercial intent.
- Research Use. Researchers may use, administer, copy, distribute and modify the Assessment, create derivative works including translations and short forms, validate it in new populations, and disseminate and publish works based on or including it. See Derivative Works for further details.
- Use within the NovoPsych platform. Subscribers administer and score the Assessment on the NovoPsych platform under the Terms and Conditions & SaaS Contract, which prevails over this Agreement for platform use.
4. Free Use Limits for Commercial Use
Commercial Use is permitted without a fee only while both of the following are true:
- the Organisation’s use does not exceed 1,000 Administrations of the Assessment in a calendar year; and
- if the Assessment is integrated into software, a website, an application or a service, no more than 100 Users (e.g. practioners) have access to it through that software in a calendar year.
Use above either limit requires a Commercial Licence under clause 5. Use is counted across the whole Organisation and may not be divided between practitioners, sites or entities to stay within the limits.
5. Commercial Licence and Fees
Commercial Use above the Free Use Limits requires a Commercial Licence from NovoPsych. NovoPsych’s base fee is A$2,000 per 1,000 Administrations per calendar year, exclusive of GST. Fees for software integration, for more than 100 Users, and for high volumes are quoted on application via our contact page. A Commercial Licence does not extend to a Competing Service, which requires a separate written agreement.
6. Restrictions
The following restrictions apply to every user of the Assessment, including users whose use is otherwise free under clause 3.
- No Competing Services. Nothing in this Agreement licenses any use of the Assessment in, for or in connection with a Competing Service. A person who builds, operates, supplies or contributes to a Competing Service receives no licence under this Agreement and must obtain a separate written licence from NovoPsych before any use.
- Open scoring, protected platform logic. The scoring keys and norms NovoPsych publishes for the Assessment are open and may be used freely under this Agreement. What is not licensed is NovoPsych’s unpublished Scoring Logic and Platform Outputs: you must not extract, reconstruct, reverse engineer or approximate NovoPsych’s platform scoring, percentile, reliable-change or interpretive logic beyond what NovoPsych publishes, whether from Platform Outputs or by systematically submitting responses to the NovoPsych platform to infer how results are computed or described.
- No use in competing systems or models. You must not use the Assessment, its Scoring Logic or Platform Outputs to design, build, train, fine-tune, evaluate, prompt or improve any software, model or service that administers, scores, interprets or reports on psychometric assessments for third parties.
- No automated collection. You must not use scrapers, crawlers, bots, bulk-download tools or automated querying against the NovoPsych website or platform.
- No commercial sublicensing. You must not sublicense the Assessment to third parties for commercial purposes.
- No misrepresentation. You must not represent ownership of the Assessment, remove or alter attribution or copyright notices, present a modified version as the original, or present the Assessment or a derivative work as endorsed by NovoPsych without written consent.
A breach of this clause is a material breach and terminates the licence immediately under clause 11.
7. Attribution and Derivative Works
- Distribution of derivative works. You may distribute, publicly display and perform derivative works created from the Assessment, including translations and adapted forms, provided they comply with this Agreement.
- Attribution and ShareAlike. If you use, publish, modify or create a derivative work based on the Assessment, you must:
A. Credit NovoPsych as the original creator, using the full developer reference NovoPsych provides for the specific Assessment, and link to the URL where NovoPsych has published it.
B. Distribute the derivative work under the terms of this Agreement, including the Restrictions in clause 6.
C. Inform NovoPsych by email of any derivative work distributed to more than 100 individuals. - A derivative work may not be used to do indirectly what clause 6 prohibits directly.
8. No Additional Permissions Required
If your use complies with clauses 3, 4, 6 and 7, you may use the Assessment without seeking additional permission from NovoPsych.
9. Intellectual Property
NovoPsych retains all rights, title and interest in and to the Assessment and its Scoring Logic, including copyright in its items, text, graphics, and the selection, arrangement and compilation of its contents. This Agreement transfers no intellectual property rights to you. NovoPsych may use any derivative work of the Assessment without restriction.
10. Records and Audit
- An Organisation whose use is Commercial Use must keep accurate records of its Administrations and Users for each calendar year and retain them for three years.
- On written request, the Organisation must provide those records to NovoPsych within 14 days. NovoPsych may audit compliance with this Agreement, on reasonable notice, no more than once in any 12 months unless a breach is reasonably suspected.
- Where use has exceeded the Free Use Limits, the Organisation must pay NovoPsych’s standard fee under clause 5 for all use above the limits from the date the limits were first exceeded, within 30 days of invoice. Where records understate use by more than 10%, the Organisation must also pay NovoPsych’s reasonable audit costs.
- NovoPsych may monitor use of the Assessment, the website and the platform to verify compliance.
11. Termination
- Automatic termination. This licence terminates automatically if you fail to comply with any of its terms.
- Discretionary termination. NovoPsych may terminate this Agreement at its discretion on 30 days’ written notice.
- Effect of termination. On termination you must stop using the Assessment and destroy or delete copies in your possession, except that research already published and attributed in accordance with clause 7 is unaffected.
- Survival. Clauses 6, 9, 10, 12, 13 and 14 survive termination.
12. Disclaimer of Warranties
To the maximum extent permitted by law, the Assessment is provided “as is”, without warranty of any kind, express or implied, including any warranty of fitness for a particular purpose. Nothing in this Agreement excludes any guarantee or right that cannot be excluded under the Australian Consumer Law.
13. Limitation of Liability
To the maximum extent permitted by law, NovoPsych is not liable for any damages arising from the use of, or inability to use, the Assessment.
14. Governing Law
This Agreement is governed by the laws of Victoria, Australia, and the parties submit to the jurisdiction of the courts of Victoria.
15. Entire Agreement
This Agreement is the entire agreement between the parties on its subject matter and supersedes prior versions. It does not replace the Terms and Conditions & SaaS Contract, which continues to govern use of the NovoPsych platform.
16. Amendment
NovoPsych may amend this Agreement by posting a revised version on its website. Continued use of the Assessment after posting is acceptance of the amended terms. Use before the date of a revised version is governed by the version then in force.
